ISQEM speak at the Society of Construction Law (SCL-Gulf) in Qatar. 21st Sept 2010

Wayne J. Harris (Left) Julie Tuck (Center) Michael Earley (Right)
Legal experts in the construction industry have suggested that Qatar should consider establishing “a unified body of health and safety with enforcement authority.” Speaking at a Society of Construction Law (SCL–Gulf) event earlier this week on “Health & Safety in Qatar,” Clyde & Co Qatar lawyer Michael Earley said currently the legislation regarding health and safety environment (HSE) in Qatar “is scattered”. “It may be useful for Qatar to consider the implementation of a unified body of HSE legislation and enforcement authority,” Earley said during his presentation on “Health & Safety legislation in Qatar - an overview.” Currently, he said, HSE is largely subject to self-regulation, and compliance with relevant laws and regulations depends in part on the applicable sector. “This is important as the country has bid to host the Fifa 2022 World Cup,” Earley added. The lawyer also gave the example of Abu Dhabi, where an Environment HSE Management System (EHSMS) sets out relevant standards and which expects people to meet those standards. “That may be something that Qatar could be interested in,” Earley said. Currently, laws related to HSE can be found in bits and pieces in Law 4 of 1977 (preserving oil wealth), law 31 of 2002 (protection from radiation), labour law 14 of 2004, president of Supreme Council of Environment decision 4 of 2005, Qatar National Construction Standards 2007 among others. The other top international speaker at the event, Wayne Harris, Chairman of ISQEM, Board Director World Safety Organization, and HSE Director of QPM spoke about the risk management and practical issues in Qatar during his presentation on “Health & Safety Practice for the Construction Industry in the MENA region.” He suggested that HSE standards cannot be achieved simply by legislation alone, as establishing effective corporate governance and placing HSE on the board agenda are important. “Qatar, because of its recent construction boom, has a clean slate so we can get rid of things that don’t work in other countries when importing HSE standards. Talking to experts around the region is important,” Harris said. Standards and laws relating to HSE in the region largely build on those found in Australia, the US and the UK. The session was chaired by Julie Tuck of Denton Wilde Sapte, Doha
